Chupp Industrial Inc. — operating the brands Chupp Industrial, Covermore Buildings, and The Lift Bros

1. Who We Are

ChuppIndustrial.com (the "Site") is owned and operated by Chupp Industrial Inc., a family-owned Oklahoma company at 8173 S 429, Chouteau, OK 74337 ("Company," "we," "us"). The Site markets and sells products under three brands, all operated by Chupp Industrial Inc.: Chupp Industrial (mini excavators, mini skid steers, skid steer attachments, portable bathrooms), Covermore Buildings (tension fabric buildings, shelters, shipping containers), and The Lift Bros (used aerial lifts). By using the Site, requesting a quote, or placing an order, you agree to these Terms.

2. Products & Descriptions

We make reasonable efforts to describe products accurately, including specs, photos, and condition notes. Manufacturer specs may vary; used-equipment details are based on our inspection. Photos may differ from the actual item due to screen settings. We may correct errors in listings, pricing, or availability at any time, even after an order is submitted.

3. Pricing & Availability

Prices are in U.S. dollars and subject to change. Prices exclude tax, freight, delivery surcharges, and financing fees unless stated. Availability is not guaranteed until an order is confirmed in writing. We may cancel and refund orders affected by pricing errors.

4. Order Acceptance

Submitting an order or deposit is an offer to purchase, not a guaranteed sale. A sale is final only when we confirm in writing and payment (or financing approval + down payment) is received. We may refuse or cancel any order for reasons including unavailability, pricing errors, suspected fraud, or delivery-verification issues.

5. Payment & Financing

We accept the methods shown at checkout or quoted by a representative. Financing (monthly plans and pay-from-bank) is offered through third-party partners, subject to credit approval and the partner's own terms. Full payment or financing settlement is generally due before shipment or pickup.

6. Shipping & Freight

We ship nationwide via LTL and flatbed freight. Freight quotes are estimates based on destination, accessibility, and size/weight, and may be adjusted for limited-access or residential deliveries. Delivery timing is estimated, not guaranteed. Customers are responsible for site access and unloading equipment unless liftgate/limited-access service is purchased. Local pickup is available by appointment in Chouteau, OK. Risk of loss transfers to the buyer upon delivery to the carrier or upon pickup. Freight damage must be noted on the delivery receipt and reported within 48 hours.

7. Returns & Cancellations

Orders may be canceled before shipment/production for a refund minus disclosed non-refundable deposits. Custom or made-to-order items may not be cancelable once production begins. Returns are case-by-case, must be requested in writing within the invoice timeframe, and must be unused and in original condition. Used equipment (including The Lift Bros) is generally final sale (see Section 9). Restocking fees may apply.

8. Warranty

New equipment may include a limited parts warranty as described on the product page, invoice, or manufacturer documentation. EXCEPT AS EXPRESSLY STATED IN A WRITTEN WARRANTY, ALL PRODUCTS ARE SOLD "AS IS" AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Used Equipment — "As-Is" Sales (The Lift Bros)

Aerial lifts and other used equipment are sold "AS-IS, WHERE-IS," with no warranty unless separately provided in writing. Buyers should review all photos and condition notes and may request additional photos, video, or a third-party inspection before purchase. Hour meters and service history are represented to the best of our knowledge but are not independently certified unless stated.

10. SMS Communications

Chupp Industrial, Inc. offers SMS text messaging to help customers, leads, and individuals who submit product or service inquiries stay connected with our team. You can opt in two ways: through one of our website forms using the optional SMS consent checkbox, or verbally on a phone call you place to us — for example, when the person or automated assistant answering your call offers to text you a service link, a quote, or order information and you agree on that call. Calls are recorded, and we keep a record of when and how you consented. Either way, you agree to receive text messages from Chupp Industrial, Inc. We text only people who contacted us first and opted in; we never text numbers from purchased, rented, or imported lists.

Messages may include responses to your inquiries, requested quotes, product information and availability, order or purchase updates, customer service communications, and occasional promotional or marketing messages. Message frequency varies depending on your inquiries, purchases, and interactions with our team.

Consent to receive SMS messages is optional and is not required to make a purchase. Message and data rates may apply. You may opt out at any time by replying STOP to any message or reply HELP for assistance.

Carrier Liability Disclaimer

Wireless carriers are not responsible for delayed or undelivered messages. Message delivery is subject to your mobile carrier's network availability and cannot be guaranteed. Chupp Industrial, Inc. is not responsible for delays or failures in message delivery caused by your wireless carrier, network interruptions, or other circumstances outside of our control. Message and data rates may apply.

Age Restriction

By submitting a contact form and opting in to receive communications from Chupp Industrial, Inc., you confirm that you are at least 18 years of age. Our SMS messaging services are intended for individuals 18 years of age or older.

11. Phone Calls — Automated & AI-Assisted

Where a form on our Site says so — currently the freight-quote tool on a product page — entering your phone number gives Chupp Industrial, Inc. your express written consent to be called at that number about the request you submitted, including calls placed by an automatic telephone dialing system and calls using an artificial or AI-generated voice. This consent is not a condition of any purchase, and you may instead simply call us at (918) 373-9707. Forms that do not carry that notice do not grant this consent.

An automated call will identify itself as an automated assistant for Chupp Industrial, Inc. and will connect you to a member of our team on request. We call only between 8:00 a.m. and 9:00 p.m. in your local time zone and limit the number of attempts per request. Calls may be recorded or transcribed where permitted by law.

You may opt out at any time by telling the caller to stop calling or remove you, or by calling (918) 373-9707 or emailing info@chuppindustrial.com. Opt-outs are honored across Chupp Industrial, Covermore Buildings, and The Lift Bros. Consent to calls is separate from SMS consent under Section 10 — agreeing to one is not agreement to the other.

12. Website Use

Use the Site only for lawful purposes. Do not scrape the Site without permission, interfere with its security, or submit fraudulent orders. All Site content and brand names are owned by or licensed to Chupp Industrial Inc.

13. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages. Our total liability for any claim shall not exceed the amount paid for the product giving rise to the claim.

14. Governing Law

These Terms are governed by the laws of the State of Oklahoma. Disputes shall be resolved in the state or federal courts located in Oklahoma unless otherwise required by law.
